Mike Klemme Photography, Inc. d/b/a Golf As Life | Version date: August 28, 2026
Plain-language summary: Approved affiliates earn 10% on qualifying direct online product sales tracked through their Golf As Life affiliate link. This summary is for convenience; the complete terms below control.
This Golf As Life Affiliate Program Agreement (the “Agreement”) is between Mike Klemme Photography, Inc., doing business as Golf As Life (“Golf As Life,” “GAL,” “we,” “us,” or “our”), located at 222 East Maple Avenue, Suite 700, Enid, Oklahoma 73701, and the person or entity submitting the affiliate application (“Affiliate,” “you,” or “your”). By submitting an application and checking the acceptance box, you confirm that you have read, understand, and agree to this Agreement.
1. Enrollment and Approval
You must provide complete and accurate registration, contact, promotional-channel, tax, and payment information and keep it current. You must be legally able to enter into this Agreement.
Submitting an application does not guarantee acceptance. We may approve, reject, suspend, or later terminate an account when reasonably necessary to protect customers, the Golf As Life brand, its artwork, or the integrity of the program.
Unless we approve otherwise in writing, each person or business may maintain only one affiliate account. Accounts and affiliate links may not be sold, transferred, or shared.
2. Affiliate Links, Tracking, and Attribution
AffiliateWP will provide your unique tracking link and report referrals, commissions, and payouts in the Affiliate Area. A purchase qualifies only when AffiliateWP or another method expressly approved by GAL attributes the completed sale to your account.
GAL is not responsible for referrals that cannot be tracked because a customer removes or blocks cookies, changes devices or browsers, uses another referral link, purchases after the applicable tracking period, or completes an order outside the approved online path.
The current referral window and attribution settings will be stated in the Affiliate Area or program materials. GAL may change those settings prospectively after reasonable notice.
3. Commission
The standard commission is ten percent (10%) of Qualifying Net Online Product Revenue unless GAL approves a different rate in writing for a particular affiliate, product, or campaign.
“Qualifying Net Online Product Revenue” means product revenue actually received by GAL from a tracked, completed online order, after discounts, credits, refunds, returns, cancellations, chargebacks, fraud, and similar adjustments. It excludes taxes, shipping and delivery charges, gift-card value, financing charges, professional-service fees, consultation, art planning, design, installation, project management, and any other service or project charge.
Custom installations, simulator projects, wholesale orders, corporate programs, separately negotiated projects, and orders completed outside the tracked online checkout do not earn the standard 10% commission unless GAL agrees otherwise in writing before the transaction.
Self-referrals, purchases made primarily to generate a commission, fraudulent transactions, duplicate orders, and orders that violate GAL policies do not qualify.
4. Payment and Account Information
Commissions initially appear as pending and become eligible for payment only after the related order is completed, paid, and no longer subject to an applicable cancellation, refund, return, or chargeback adjustment.
Payout methods, timing, minimum thresholds, required tax information, and payment status will be shown in the Affiliate Area or current program materials. You must complete the payment and tax setup required by AffiliateWP or GAL before payment can be issued.
You are responsible for the accuracy of your payment and tax information and for all taxes arising from commissions paid to you. GAL may withhold payment when legally required, while information is incomplete, or while a referral is reasonably under review.
5. Promotion and Required Disclosure
You may promote Golf As Life through approved websites, email, newsletters, social media, video, client communications, professional networks, QR codes, and other lawful channels consistent with this Agreement.
Your promotions must be truthful, current, and based on genuine experience or opinion. You may not make claims about products, pricing, availability, discounts, delivery, income potential, or GAL that GAL has not authorized or that you know are inaccurate.
Whenever your financial relationship with GAL might not be obvious, you must clearly and conspicuously disclose it near the recommendation or affiliate link, in language ordinary people will understand. A suitable disclosure is: “I may earn a commission if you purchase through this link.” Platform tools or tags such as #ad or #affiliate may supplement, but do not replace, a clear disclosure when additional explanation is needed.
You are responsible for complying with advertising, endorsement, email, text-message, privacy, consumer-protection, and other laws that apply to your promotions. You may send commercial email or messages only with required consent and opt-out mechanisms.
6. Prohibited Practices
You may not use spam, misleading redirects, cookie stuffing, forced clicks, hidden links, adware, spyware, automated traffic, fake engagement, false reviews, impersonation, or any other deceptive or abusive method.
You may not bid on or purchase Golf As Life, Mike Klemme, Project Ansel, or confusingly similar names as paid-search keywords; register domains, social handles, pages, or accounts containing those names; or present yourself as GAL, an employee, or an authorized spokesperson.
You may not publish unauthorized coupons, discounts, prices, or promotional claims; place GAL materials on unlawful, hateful, discriminatory, sexually explicit, violent, defamatory, or intentionally misleading content; or promote GAL in a way reasonably likely to damage its reputation.
Coupon, rebate, loyalty, sub-affiliate, paid-media, or software-based promotion requires GAL’s prior written approval.
7. Golf As Life Creative Materials and Intellectual Property
During your approved participation, GAL grants you a limited, revocable, nonexclusive, nontransferable license to use the affiliate links, photographs, product images, logos, copy, banners, QR codes, and other materials GAL specifically provides for affiliate promotion (“GAL Materials”). All ownership remains with GAL or the applicable photographer or rights holder.
Use GAL Materials only to promote GAL and follow the supplied brand and usage instructions. You may adapt approved written copy to your authentic voice if the result remains accurate and compliant, but you may not materially alter photographs, remove credits or notices, modify logos, create derivative artwork, sublicense materials, sell them, or use them to train or prompt an artificial-intelligence system without written permission.
Upon request or termination, promptly stop using and remove GAL Materials and links under your control. GAL may replace or withdraw creatives, links, offers, or product information at any time.
8. Customers, Orders, and Service
Customers purchasing from GAL are GAL customers. GAL controls product selection, pricing, discounts, acceptance or rejection of orders, production, fulfillment, shipping, returns, customer service, and all related policies.
You may not accept payment, bind GAL, promise delivery, resolve claims on GAL’s behalf, or make commitments for GAL unless specifically authorized in writing.
9. Communications and Confidentiality
You consent to receive operational emails concerning your application, account, program updates, creatives, payments, and compliance. Keep nonpublic customer, pricing, campaign, technical, financial, and business information confidential and use it only for authorized program activity.
10. Term and Termination
This Agreement begins when GAL accepts your application and continues until terminated. Either party may terminate participation at any time by written or electronic notice. GAL may suspend or terminate immediately for suspected fraud, legal or policy violations, misuse of GAL Materials, reputational risk, or other material breach.
After termination, you must stop presenting yourself as an affiliate and remove GAL links and materials. Properly earned commissions from qualifying pre-termination sales remain payable after adjustments, but commissions connected to fraud, prohibited conduct, or invalid orders may be denied or reversed.
11. Independent Contractor and Taxes
You are an independent contractor, not an employee, agent, partner, franchisee, joint venturer, or sales representative of GAL. You have no authority to bind GAL. You control how and when you conduct lawful affiliate promotion and bear your own costs, insurance, licenses, and taxes.
12. Disclaimers, Indemnification, and Limitation of Liability
The program, website, AffiliateWP functions, links, reporting, and GAL Materials are provided on an “as available” basis. GAL does not guarantee uninterrupted operation, traffic, sales, commissions, or any particular income.
To the extent permitted by law, you will defend, indemnify, and hold harmless GAL and its officers, employees, contractors, photographers, successors, and assigns from third-party claims, damages, and reasonable costs arising from your promotions, content, legal violations, negligence, misconduct, or breach of this Agreement.
To the extent permitted by law, GAL will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages or lost profits arising from the program. GAL’s aggregate liability related to the program will not exceed the commissions paid or payable to you during the twelve months preceding the event giving rise to the claim.
13. Changes to the Program or Agreement
GAL may modify products, commission rates, tracking, payment procedures, creatives, policies, or this Agreement prospectively. Material changes will be posted in the Affiliate Area, on the GAL website, or sent to the email associated with your account. Continued participation after the stated effective date constitutes acceptance; if you do not agree, you must stop participating and terminate your account.
14. General Terms
Oklahoma law governs this Agreement, without regard to conflict-of-law rules. After a good-faith effort to resolve a dispute informally, the state and federal courts serving Garfield County, Oklahoma, will have exclusive jurisdiction and venue.
You may not assign this Agreement without GAL’s written consent. If any provision is unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will continue. GAL’s delay in enforcement is not a waiver.
This Agreement, together with incorporated program policies and any written rate or campaign terms, is the entire agreement concerning the affiliate relationship and supersedes prior discussions on that subject. Electronic records, check-box acceptance, and electronic notices are valid and enforceable.
